Terms of Service

Welcome, and thank you for your interest in 7Environmental Inc. ("7Environmental," "we," or "us"). These Terms of Service ("Terms") govern your access to and use of our website and related online materials, features, and tools (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

Please also review our Privacy Policy, which describes how we collect, use, and disclose information. If you are accepting these Terms on behalf of an entity, you represent that you have authority to bind that entity.

1. Access and Use

Subject to your compliance with these Terms, 7Environmental grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for lawful business-information purposes.

The Service described in these Terms is limited to our public marketing website and informational experience. If you proceed to our logged-in application, separate in-app terms of service and privacy disclosures presented before access will govern your use of that application.

2. Eligibility

You must be at least the age of majority in your jurisdiction or 18 years old, whichever is higher, to use the Service. By using the Service, you represent and warrant that you satisfy these requirements and that your use complies with applicable law.

3. Use Restrictions

Except to the extent prohibited by applicable law, you may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying structure of the Service.
  • Copy, modify, distribute, sell, sublicense, or create derivative works from the Service or site content except as expressly permitted by law.
  • Probe, scan, or test vulnerability of the Service, or interfere with the Service's operation, security, or availability.
  • Scrape, harvest, or otherwise extract data from the Service using unauthorized automated means.
  • Use the Service in a way that infringes, misappropriates, or otherwise violates third-party rights or applicable law.
  • Upload or transmit malicious code, harmful material, or content you do not have the right to submit.

4. Ownership and Licenses

The Service, including all text, graphics, logos, trademarks, service marks, and other content, is owned by or licensed to 7Environmental Inc. and protected by intellectual property laws. Except for the limited access rights in these Terms, no rights or licenses are granted to you by implication or otherwise.

If you choose to provide suggestions, comments, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use that feedback for any lawful purpose without compensation.

6. Modification of Terms

We may modify these Terms from time to time. When we do, we will post the updated version with a revised "Last updated" date. Your continued use of the Service after any update becomes effective constitutes acceptance of the updated Terms.

7. Modification of Service

We may modify, suspend, or discontinue all or any part of the Service at any time, with or without notice, to the extent permitted by law. We are not liable for changes, interruptions, or discontinuation of the Service.

8. Termination

You may stop using the Service at any time. We may restrict, suspend, or terminate your access if we believe you violated these Terms, applicable law, or created risk to the Service, us, or others.

9. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." 7ENVIRONMENTAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. LIMITATION OF LIABILITY

10.1 No Indirect Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, 7ENVIRONMENTAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

10.2 Liability Cap

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF 7ENVIRONMENTAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED USD $100.

11. Indemnity

You agree to defend, indemnify, and hold harmless 7Environmental Inc. and its affiliates, officers, directors, employees, and agents from and against liabilities, claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your misuse of the Service, your violation of these Terms, or your violation of applicable law.

12. Dispute Resolution

12.1 Agreement to Arbitrate

Except for matters that may be brought in small claims court and claims seeking injunctive or equitable relief for intellectual property misuse or security abuse, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under applicable AAA rules.

12.2 Class Action and Representative Waiver

You and 7Environmental agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action.

12.3 Pre-Arbitration Notice

Before starting arbitration, the party seeking relief will provide a written notice describing the claim and requested relief. Notices to 7Environmental must be sent to:

If the dispute is not resolved within 60 days after notice is received, either party may commence arbitration.

12.4 Arbitration Procedures

The arbitration will be conducted by a neutral arbitrator in accordance with AAA rules as modified by these Terms. The arbitrator may award the same individual relief available in court. Arbitration fees will be allocated under applicable AAA rules unless otherwise required by law.

12.5 Arbitration Confidentiality

To the extent permitted by law, the arbitration proceeding and any resulting award will be confidential.

12.6 Arbitration Opt-Out

You may opt out of arbitration by emailing legal@the7e.com within 30 days of your first use of the Service. Because the Service currently does not require account creation, your opt-out request must include your full name, contact email address, a clear statement that you are opting out of arbitration, and your self-attested first-use date.

12.7 Severability of Dispute Terms

If any part of this dispute resolution section is found unenforceable, that part will be severed and the remaining provisions will remain in effect to the fullest extent permitted by law. Nothing in this section limits rights that cannot be waived under applicable law, including applicable California law.

13. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflicts of law principles.

For disputes not subject to arbitration, you and 7Environmental consent to exclusive jurisdiction and venue in state or federal courts located in Wake County, North Carolina.

14. Miscellaneous

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, form the entire agreement between you and 7Environmental regarding the Service. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or by operation of law.
